The Government will publish the a list of civil servants with signing authority

Willemstad – In order to comply with the Kingdom Law, the government will publish a list of civil servants with signing authority. The Minister of Finance keeps a list of names and functions of civil servants with signing authority that binds the government to a financial obligation. The government’s financial obligation occurs, for instance, when on the basis of a decision a civil servant signs an order form for a company to deliver products and/or give the government its services. The government deems it very important that the company know which civil servants have signing authority. By means of this signature, the civil servant binds the government financially.

Technically the government can control the separation of each function the civil servant fulfills. The government prefers to treat certain functions separately. By means of the separation of functions, the government has a better view of contradicting interests in order to manage functional processes and thus avoid opportunism.

The functions to be separated are as follows:
The function in which the civil servant has signing authority; the civil servant gives the government a task to perform, in this case he/she connects the government to a third party.

The functions in which the civil servant archives property: he/she archives property and delivers property to the civil servant with signing authority.

The function in which the civil servant registers: he/she registers assignments, distributes the confirmation of the implementation of the automatic, administrative and financial system, in other words, the whole process of the management and implementation of government services.

The function in which the civil servant monitors: the civil servant compares data in the administrative, financial system with reality; he/she also monitors and investigates the compliance of the law and rules.

The implementation function: the civil servant implements an order for the civil servant with signing authority.

The list contains the following data: the maximum sum for which the civil servant concerned can sign a day and the act is he/she is authorized to sign with legal consequences. The government will publish the list after each adaptation, in any case they will publish an update every 6 months. The government will publish the list on their website, on the page of the Minister of Finance.
